Minnesota Eviction Moratorium Phaseout: On June 29, 2021, the State of Minnesota enacted a law (see Article 5) which phases out the COVID-19 based moratorium that suspended evictions and landlord-initiated lease terminations since March 2020. This law creates a timeline for allowing different types of lease terminations and evictions. It also creates some protections against certain types of evictions and requires advance notice of evictions for nonpayment of rent. The new law protects tenants who have a pending application for emergency rental assistance from an eviction for nonpayment of rent through the RentHelpMN program.

There are three important things to know:

  1. Tenants who are behind on rent should immediately apply for emergency rental assistance through RentHelpMN.org or by calling 2-1-1 or 800-543-7709. Applying for this assistance can protect tenants from eviction for nonpayment of rent while they are waiting for their application to be processed and the money paid out. This protection lasts until June 1, 2022, but only for those tenants who have pending applications, so applying for this assistance is an essential first step.
  2. Tenants should receive a notice from their landlord 15 days before an eviction for nonpayment is filed. This will give tenants time to apply for emergency rental assistance and protect them from eviction while the application is pending. This protection lasts until October 12, 2021 (105 days after this law was enacted).
  3. Some tenants may be subject to lease termination, lease non-renewal, and/or eviction immediately for a few specific reasons. Detailed information regarding this can be found here. Then, over a series of several key dates on a 105-day timeline, additional types of lease terminations, lease non-renewals, and evictions can be filed. Tenants who dispute a specific type of lease termination, lease non-renewal, or eviction should seek legal advice immediately by calling 2-1-1 or 800-543-7709 for available legal resources or visit LawHelpMN.org for more information.

Overview of Minnesota’s Eviction Moratorium Phaseout Timeline:

  • June 30: Leases can be terminated for a "material breach of lease", excluding nonpayment of rent.  Renters who qualify for rental assistance but refuse to apply can be evicted.
  • July 14: Tenants can be evicted for materially violating their lease agreements, excluding nonpayment of rent.
  • August 13: Leases can be terminated for tenants that do not qualify for COVD-19 rental assistance due to nonpayment of rent.
  • September 12: Tenants who are not eligible for COVID-19 rental assistance can be evicted for the nonpayment of rent.
  • October 12: All lease termination and eviction protections are lifted EXCEPT for eligible renters that have a pending COVID-19 rental assistance applications.
  • June 1, 2022: All lease termination and eviction protections are lifted.

Minnesota Eviction Moratorium: Governor Walz issued an extension to the peacetime emergency for another 30 days. This means the suspension on evictions currently remains in place through Monday, June 14, 2021.

CDC/Federal Eviction Moratorium: CDC Eviction Moratorium Order provides a temporary halt in residential evictions. The Order is effective April 1, 2021 and will remain in effect through June 30, 2021. The Eviction Protection Declaration form can be found here.

Steps to take if you are being evicted:

Step 1:  Contact your landlord

Let your landlord know you are looking for help. Ask if you may be eligible for payment plans or an extension while you look for resources that may be able to help with the bill. Be sure to ask for any agreements with your landlord in writing and keep a record of all your communications.

 
Step 2:  Find out if you qualify for RentHelpMN

This program was created to help Minnesotans who have fallen behind on their rent or fear that could happen. RentHelpMN is currently in Phase One, in which people with past due rent who meet eligibility requirements are invited to apply. Apply Here

 
Additional rent payment assistance:

Find help with additional rent payment assistance by calling 2-1-1, texting your zip code to 898-211, or visiting the United Way 2-1-1 website – even if you are not being evicted. Pay what you can now and look for additional help to get caught up with your bills.

Step 3: Additional eviction prevention services may be available in your area

If you are facing eviction, it is best to seek legal services right away. This will give you time to apply, arrange an appointment, and gather any documents you may need.

Step 4: Make a plan

You might need to find a new place to live. Find help with shelter if you have no other place to stay by calling 2-1-1 or texting your zip code to 898-211. Begin thinking of moving expenses and finding places to keep any items you may need to store until you can find a place of your own.

Visit HousingLink to search for affordable rental housing vacancies and waiting list openings in Minnesota.

Find eviction resources by visiting the United Way 2-1-1 website and searching the database of agencies and programs available to residents of Minnesota. Be sure to read all the program details, especially eligibility, to find where to go, what to bring, and how to apply even if you can’t get in touch with the agency right away. Directions:

  2. Scroll down to the Guided Search area:

  4. Click on the appropriate type of resource you are looking for
  5. Scroll to the top of the page in the Location search field, click on the down arrow next to Near and select Serving
